1. Copyright Infringement Notification

1.1 Reporting Infringement

If you believe in good faith that content available on the NaijaAssets Platform infringes your copyright or the copyright of a person you are authorized to represent, you may submit a written notification of claimed infringement to our Designated Copyright Agent.

1.2 No Legal Advice

The following information is provided for informational purposes. You should consult an attorney if you are unsure whether your copyright rights have been infringed or about the legal requirements of filing a DMCA notice.

2. Notification Requirements

2.1 Required Information

To be effective, a DMCA notice must include substantially all of the following:

  • Your physical or electronic signature (or the signature of a person authorized to act on behalf of the copyright owner)
  • Identification of the copyrighted work claimed to have been infringed, or if multiple works are covered by a single notification, a representative list of such works
  • Identification of the material claimed to be infringing or the subject of infringing activity, and information reasonably sufficient to permit us to locate the material (such as the specific URL or location on the Platform)
  • Your contact information, including name, address, telephone number, and email address
  • A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law
  • A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed

2.2 Submission

2.3 Response

Upon receipt of a valid DMCA notice, we will:

  • Acknowledge receipt of the notification
  • Promptly investigate the claimed infringement
  • Remove or disable access to the allegedly infringing material expeditiously
  • Notify the user who posted the material of the removal or disabling
  • Take reasonable steps to promptly notify the affected user of the takedown

3. Counter-Notification

3.1 Right to Counter-Notice

If you believe that material you posted was removed or disabled as a result of a mistake or misidentification, you may submit a counter-notification to our Designated Copyright Agent.

3.2 Counter-Notice Requirements

A counter-notification must include substantially all of the following:

  • Your physical or electronic signature
  • Identification of the material that was removed or disabled and the location where the material appeared before removal or disabling
  • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification
  • Your name, address, telephone number, and email address
  • A statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or if your address is outside the United States, to the jurisdiction of any judicial district in which NaijaAssets may be found), and that you will accept service of process from the person who provided the original infringement notification or their agent

3.3 Submission

3.4 Response to Counter-Notice

Upon receipt of a valid counter-notification, we will:

  • Provide a copy of the counter-notification to the original complainant
  • Inform the original complainant that the removed material will be restored in ten (10) business days
  • Replace the removed material or cease disabling access to it within ten (10) to fourteen (14) business days following receipt of the counter-notification, unless the original complainant files a court action seeking to restrain the alleged infringement and notifies us of such action

4. Repeat Infringer Policy

4.1 Policy

NaijaAssets maintains a policy of terminating, in appropriate circumstances, the accounts of users who are repeat infringers of copyright.

4.2 Determination

We determine what constitutes a "repeat infringer" at our discretion, considering factors including the number of valid DMCA notices received regarding a user's content, the severity of the alleged infringements, and the user's response to previous notices.

4.3 Account Termination

We reserve the right to terminate the accounts of users who are determined to be repeat infringers, regardless of whether formal DMCA notices have been filed for each instance.

5. False Claims

5.1 Misrepresentations

Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that content is infringing or that content was removed by mistake may be liable for damages, including costs and attorneys' fees.

5.2 Good Faith

We take all claims seriously. However, submitting false or frivolous DMCA notices or counter-notices may subject the submitter to legal liability.
